ICJ Has Rejected Indian’s Plea for Kulbhushan Jadhav’s Release | Reconsider for Death Penalty

International Court of Justice has announced on 16 July 2019 that Kulbhushan Jadhav cannot be released on Indian’s application.  It is a great victory by Pakistan in a sense that no Indian is allowed to take back their spy commander.  Although the Indian people and all the Indian channels are celebrating the success on behalf of ICJ judgment but they should realize the outcome of this verdict.


Spy commander Kulbhushan Jadhav will be in the jail and custody of Pak army or Pakistan police and security agencies. So, no one is allowed to bring him back to India. He was arrested in Pakistan on March 2016.That’s real success for Pakistan. Why are Indians celebrating the success then? It could be for face-saving that’s why all Indian media channels united on that issue.

Yes, it could be a success up to a specific limit in a sense that Indian officials can have access to Kulbhushan Jadhav after getting permission from the higher authorities in Pakistan. But it is not easy to meet and have breakfast with him because Kulbhushan is not a chief guest or a V.V.I.P personality. Now we can say once again, he is a killer and a confirmed terrorist after hearing the judgment of the International Court of Justice.

However, ICJ insisted Pakistani government to review the punishment that is given to him by military Court but the international judges did not put any kind of restriction or liability for further proceeding.

Indian officials also requested that all the allegations and the cases that were made in Pakistan after March 3rd 2016 should be declared null and void.  Kulbhushan Jadhav is the son of India as we watched on the media but the fact is, he may be a son of India but he is also a son of the terrorist mindset.

He just knows how to kill the people, he just knows how to spread the terrorist activities and destroy the peace of a country.

Pakistani officials proved that spy commander is an Indian Navy officer and he has been involved in many attacks and terrorist activities in Balochistan.

The ICJ also stated it had only one option and that was “to ask Pakistan for counter check or review the case. However, the court finds the violation regarding article 36 of Vienna Convention n behalf of the Pakistani government.

The court added, Kulbhushan had no access to Indian foreign office or legal help as it was his basic right during the trial period.

Pakistani government took a stand when a person is declared as a confirmed terrorist and the person is involved in any secret operation against the country then we cannot allow access for everybody to visit him or her. Because, it may be dangerous for that person’s life and also the risky situation it could be for the persons who are appointed for the security.

Article 36 of the Vienna Convention simply declared, if a national of some other country is involved in any illegal activity or terrorist act and get arrested then he/she must be given access to the respective consulate office.

Final words are, Kulbhushan is in Pakistan and the courts either military or civilian will decide how to proceed the matter? But whatever is executed, it will be in the great favor of Pakistan and the nation of Pakistan.
